Worker receives back pay for time off work

Lawyer-in-charge: Karena Nicholls

A dispute arose in relation to entitlements to workers compensation following an investigation into conduct directed by the employer. The employer originally accepted the claim provisionally and later declined it on the basis of s11A of the Workers Compensation Act 1987.

They allege that he was being investigated and that is the reason he went on workers compensation. We were successful in arguing the loss of income to this worker and he received back pay for the time off work.
