Our client was the father in a complex parenting and property matter following separation. He had remained living in the family home with the two children while the mother had alternate weekend time with them. Suddenly, he was served with urgent Court documents, only a week before his response was due. He needed fast, reliable legal support to protect his living arrangements and his children’s care.
The mother filed an urgent interim application seeking to reverse the family’s living arrangements — she asked for the father to be removed from the home, for her to move back in, and for her to take over as the children’s primary carer.
With only a week to act, Shannan worked quickly to draft, file, and serve response documents. At the first mention in Court, the Registrar deemed the matter so urgent that she had the parties wait for 5.5 hours to grant an urgent interim hearing, listed just one week later.
Shannan immediately began preparing: briefing a barrister, ensuring the client was supported and fully informed, and working through the evidence to be presented. She then attended Court to instruct the barrister and provide on-the-ground support during her very first interim hearing appearance.
Shannan achieved an excellent outcome for our client. The Registrar made interim orders in the father’s favour, allowing him to remain in the family home with the children. The mother’s time was set at five nights per fortnight, giving the children stability while maintaining their relationship with both parents.
This result was almost entirely in line with the orders we were seeking, and the matter is now set to return to Court at the end of October for a further interim hearing once a single expert report has been prepared.
