A will is a legal document that specifies how you wish your assets and liabilities to be distributed following your death.
In mid-2024, Shannan was booked to assist an elderly couple residing in a nursing home with the preparation of their new Wills. One of the clients, who was legally blind, required additional support to ensure that their wishes were properly communicated, understood, and documented with care and precision.
Understanding the sensitivity of the situation, Shannan visited the nursing home accompanied by two colleagues to act as witnesses. The Will was read aloud in full to the client to ensure they comprehended every clause before signing. An affidavit of attesting witness was also prepared to formally confirm the circumstances of the signing and to protect the validity of the document should it ever be challenged.
Following the client’s passing a few months later, our firm was contacted by their family to assist with the Probate process. Because of the forward-thinking steps taken during the Will’s execution, including the presence of multiple witnesses and the supporting affidavit, our team was able to lodge a smooth application for Probate without any requisitions or delays.
As a result, the Grant of Probate was secured efficiently, and the estate was fully administered and distributed within a matter of months, leaving the family deeply relieved and grateful during an otherwise difficult time.
