This case involved an asset pool of approximately $1.5 million, that generated many complexities in determining the valuation of financial contributions of each party. In this particular case, the father was non-compliant with court orders that directed him to vacate the former matrimonial home. This called for the need for an enforcement warrant to enforce these orders and to facilitate the vacation of the premises by the respondent.
The orders further stipulated an agreement for the sale of a residential property which required a contract of sale that was executed by Christine Basset, a Coutts Conveyancer.
Significant investments and financial contributions during the relationship by the mother and some further negotiations allowed for a successful resolution ensuring our client was satisfied with the result of retaining 60% of the property pool. The husband’s failure to attend court and misleading allegations in relation to the mothers parenting acted in favour of our client. Overall, the case highlights that despite various complexities and crossovers between different areas of law, Coutts always aims to act in the best interests of our client.
