The case involved a complex parenting and property dispute that required a final hearing initially set for seven days but was successfully settled in just three. On the first day of the hearing, the parties reached an agreement regarding parenting arrangements, ensuring that the best interests of the children were prioritised and addressed. The property aspect was settled on day three as the parties were able to reach an agreement in relation to the division of the property pool.
A significant point of contention in the property division involved the opposing party’s claim for a 70/30 split in their favour. The opposing party sought this split on the basis that significant costs had been incurred for the construction of a dwelling. Leading up to the final hearing, we reviewed evidence that effectively disproved the opposing party’s claims regarding these costs.
Ultimately, the parties were able to reach an agreement whereby our client received a 65/35 split in her favour. This outcome reflected the contributions our client made as the primary caretaker and homemaker. The resolution of the property matters, alongside the parenting arrangements, provided our client with a sense of relief and satisfaction.
