Assault charges dismissed following compelling submissions
Our client was a 49 year old man charged with common assault following an argument with his son. During Covid lockdown, our client’s son invited drug dealers to the family home while no one else was home. When questioned, the argument became heated and our client pushed his son trying to evoke a response. Following successfully negotiating an amendment to the facts, we made submissions to the Court that the criminality of our client’s actions did not warrant criminal punishment. We defended robust objections from the Prosecution and the Magistrate ultimately agreed with our submissions. Our client’s charges were dismissed.
