Upcoming AML/CTF Requirements: What This Means for You

From 1 July 2026, changes to Australia’s Anti-Money Laundering and Counter-Terrorism Financing laws may affect how some legal services are provided.

These changes are designed to help prevent money laundering, terrorism financing and other serious financial crime.

For clients, this means there may be times when Coutts Lawyers & Conveyancers is required to collect and verify certain information before we can provide some services, or while we continue to act for you.

We understand this may feel like an extra step. Our team will guide you through what is needed and will only ask for information required for your matter.

What is AML/CTF?

AML/CTF stands for Anti-Money Laundering and Counter-Terrorism Financing.

These laws are designed to stop criminals from using legitimate businesses and professional services to hide, move or disguise money linked to crime.

Under these requirements, some legal services may require us to collect and verify information about our clients, the purpose of the legal work, the people involved in a business or company, and in some matters, the source of funds.

Why These Changes Matter

The upcoming AML/CTF requirements are intended to help protect clients, businesses and professional services from being misused for criminal activity.

These steps help:

  • Protect clients and services from criminal misuse
  • Meet legal obligations
  • Support a safe and secure financial system
  • Help prevent money laundering, terrorism financing and other serious financial crime

What You May Be Asked For

Depending on your matter, you may be asked to provide information or documents so we can meet our legal obligations.

This may include asking you to:

  • Verify your identity
  • Explain why you require our legal services
  • Confirm who owns or controls a business, company, trust or account
  • Explain where funds being deposited into our trust account have come from
  • Provide supporting documents to confirm the source of funds
  • Keep your details up to date
  • Provide additional information where required

These checks are a standard legal requirement and may apply to many clients and services.

How do you verify your identity?

You may be asked to verify your identity by providing official documents that confirm your name, date of birth and/or residential address. This could include a driver licence, passport, Medicare card, birth certificate or recent utility bill. Depending on your matter, this may be done in person, by certified copies of documents, or through a secure electronic verification system.

Businesses, Companies and Trusts

If you are acting for, or on behalf of, a business, company, trust or other structure, we may need to collect and verify information about the people who own or control that entity.

This may include information about directors, shareholders, beneficial owners, trustees, appointors, beneficiaries or other people who have ownership or control.

The information required will depend on the type of matter and the structure involved.

Source of Funds

In some matters, we may be required to ask where funds have come from, particularly where money is being deposited into our trust account.

This may include asking for information or documents that help confirm the source of those funds.

Examples may include documents relating to a property sale, loan, savings, business funds, inheritance, sale of assets or other relevant sources.

What Happens If Information Cannot Be Provided?

If we are unable to collect or verify the information required under the AML/CTF laws, we may not be able to provide some legal services.

If this applies, we will explain what is needed and work with you to make the process as clear and straightforward as possible.

Any information you provide will be managed securely and in accordance with our privacy obligations.
