Kay’s client had purchased a brand new house in a retirement village which shortly after taking occupation of the property was unfortunately flooded to the extent that the backyard was not able to be accessed. Luckily this occurred during the Change of Mind Guarantee period and she was able to recover the majority of the funds from the purchase.
The client then purchased again an off the plan brand new house in a different retirement village. A few days before it was due to settle, the client inspected the house, as it was by then built, and was horrified to note that a visitor only parking space was placed directly in front of the entry way to her new home. It was not shown this way on the masterplan she inspected prior to signing the Contract.
Kay successfully negotiated with the village for her client to be able to switch the property she had planned on purchasing with another newly built property, at a lesser cost, and have her deposit transferred from the previous Contract to the new Contract. The settlement and move in date were kept the same and the client was able to save money, move in as per scheduled and did not incur any additional cost.
